NEW TRADEMARK CLIENT/REQUEST

 

PLEASE TAKE NOTE: This page is for use ONLY if you have been directed to this page by a separate email communication from an attorney in our firm, then in that event, the following will outline our retainer requirement, as well as trademark costs in searching and applying for federal registration of a given mark.  USE OF THIS PAGE UNDER ANY OTHER CIRCUMSTANCES IS PROHIBITED.

Prior to searching or applying for registration, you will need to describe in detail the goods and services to be identified with the mark. We have not yet searched the marks, reviewed any legal issues for you, nor rendered any legal services. We will proceed only if we are retained as outlined herein.

CHARGES - EFFECTIVE THROUGH CURRENT YEAR ONLY:

  • U.S. Trademark Application - 1 class - per mark is USD $520.00 (plus gov't filing fee of $350 per class)

  • U.S. Trademark Search - full search - per mark is USD $3250.00
  • U.S. Trademark Search - federal only - per mark is USD $975.00

The retainer to be maintained throughout representation is USD $5,000.00 ("Retainer").   Please note that the Retainer is not a charge, but rather a deposit out of which your fees/expenses will be billed for all services, fees and costs incurred in providing legal representation. The scope of legal representation to be provided is limited to the searching of the marks indicated hereon, if requested by you and approved by us, and the preparation and filing of a Federal trademark application for the mark set forth above only upon our receipt of all required information, items, and subsequent approval from you, and excludes all other representation and matters. Our fees reflect the value of our services and may be based on, among other things, hourly billing rates, the complexity of the matter, the skill and experience required to perform the services, the time constraints imposed by the circumstances and the size of the matter, among other factors. The hourly billing rate for attorney time is USD $550. Paralegals assigned in this matter bill at the hourly rate of $275. Those rates are adjusted in the ordinary course from year to year. Account summaries are in most cases sent out each month and cover the period of the previous month. You have agreed to maintain the Retainer with us during the course of representation. Your account billings will be deducted from the Retainer as billed, and you will then replenish the deducted amount upon receipt of your invoice.  At the conclusion of your matter, any unearned Retainer balance is refundable to you. In the event that the nature or scope of our representation changes, we may increase the amount of the Retainer requirement accordingly. Expenses, costs, and disbursements (for example, postage, FedEx, long distance, photocopies) are charged as they are incurred. Past due balances shall be charged interest at the rate of 1.0% per month.
